Terms of Use - Selima

⚠️Fundamental notice: Selima is an AI-powered emotional wellness companion tool. It is not a medical, therapeutic, or emergency service. If you are in crisis, contact 988 (USA), Línea 106 (Colombia), 024 (Spain), or go to your nearest emergency room.

1. Acceptance of Terms

By downloading, installing, or using the Selima application ("the App"), you accept these Terms of Use and our Privacy Policy. If you do not agree, do not use the application.

Selima is developed and operated by DM-AI Solutions ("we", "our", "us"). We reserve the right to modify these terms, notifying you through the App.

2. Description of Service

Selima offers:

AI-powered emotional wellness conversations
Mood tracking and check-ins
Personal journal with optional AI analysis
Breathing, meditation, and mindfulness exercises
Wellness tools based on psychology techniques

Selima is NOT: a mental health service, a substitute for therapy or professional counseling, an emergency medical service, or a provider of diagnoses or medical treatments.

3. Eligibility

To use Selima you must be at least 16 years of age. If you are under 18, you declare that you have the consent of your parent or legal guardian.

4. Your Account

You are responsible for maintaining the confidentiality of your account and password. All activity under your account is your responsibility. You must notify us immediately if you suspect unauthorized access.

5. Plans and Payments

Selima offers a free plan with limited features and paid plans with additional benefits:

Free Plan: Basic features with a daily message limit.
Plus Plan: More daily messages, access to advanced AI models, and premium features.
Pro Plan: Unlimited messages and all features.

Payments are processed through the Apple App Store or Google Play Store depending on the platform. Refund policies are governed by each store's terms and conditions.

Subscriptions renew automatically. You can cancel at any time from your app store settings.

6. Use of Artificial Intelligence

By using Selima's chat, you understand and accept that:

Responses are generated by AI models and may contain inaccuracies.
Responses do not constitute medical, psychological, or professional advice.
You should not make medical or health decisions based solely on Selima's responses.
The AI cannot diagnose conditions or prescribe treatments.
In crisis situations, the AI will provide emergency resources but is not an emergency service.

7. Acceptable Use

You agree not to use Selima to:

Engage in illegal activities or infringe on the rights of others.
Attempt to manipulate, hack, or overload the application's systems.
Create abusive, offensive, defamatory, or hate-inciting content.
Attempt to extract or collect data from other users.
Reverse-engineer the software or AI models.

8. Intellectual Property

Selima, including its design, code, content, brand, and associated materials, is the property of DM-AI Solutions. Your content (journal, mood records, conversations) remains yours — we only use it to provide you with the service.

9. Limitation of Liability

Selima is provided "as is" without warranties of any kind. DM-AI Solutions is not liable for:

Decisions you make based on AI responses.
Temporary service interruptions.
Indirect, incidental, or consequential damages arising from the use of the App.
Inaccuracies in AI-generated responses.

Our total liability is limited to the amount you have paid for the service in the last 12 months.

10. Termination

You may stop using Selima and delete your account at any time. We reserve the right to suspend or terminate your access if you violate these terms, without prior notice.

11. Governing Law

These terms are governed by the laws of Costa Rica. Any dispute shall be resolved in the competent courts of Costa Rica.
